Iglesia El Getsemani Mobile Application

1. Acceptance of Terms

By downloading, installing, accessing, or using the Iglesia El Getsemani mobile application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you ("you" or "user") and Iglesia Cristiana El Getsemani (the "Church," "we," "us," or "our"), a 501(c)(3) nonprofit religious organization located in Pottstown, Pennsylvania.

We reserve the right to modify these Terms at any time. Changes will be posted within the App or on our website at iglesiaelgetsemani.org with an updated effective date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to modified Terms, you must discontinue use of the App and delete your account.

2. Description of Service

The App is a free mobile application that provides members and visitors of Iglesia Cristiana El Getsemani with the following services:

  • Bible Reading: Access to the Bible in English (NKJV) and Spanish (Reina-Valera 1960) with customizable reading themes, a daily verse, and search functionality. Bible reading is fully offline and does not collect any user data.
  • Sermon Videos: A catalog of sermon recordings and live stream access from the Church's YouTube channel.
  • Giving: The ability to make voluntary financial donations to the Church through secure payment processing.
  • Events: A listing of church events with the ability to RSVP and add events to your device calendar.
  • Push Notifications: Optional alerts about live streams, events, service changes, and church announcements.
  • Church Information: Service times, location, contact information, and links to the Church's social media.

The App is provided as a convenience for our community. It is not a substitute for in-person participation in church activities.

3. Eligibility

  • General use: You must be at least 13 years of age to create an account and use account-based features of the App (including event RSVPs and push notification subscriptions).
  • Donations: You must be at least 18 years of age (or the age of majority in your jurisdiction) to make financial donations through the App.
  • Guest access: Users of any age may access the App in guest mode (Bible reading, sermon videos, church information) without creating an account. Parents and guardians are responsible for monitoring their minor children's use of the App.

By creating an account, you represent and warrant that you meet the applicable age requirements stated above.

4. Account Registration

Authentication Methods

The App supports the following authentication methods depending on your platform:

  • Sign in with Apple (iOS)
  • Sign in with Google (Android)

When you create an account, your authentication provider shares your name and email address with us (which may be a private relay address if you choose to hide your email through Apple). We do not receive or store your Apple ID password, Google password, or any other authentication credentials.

Your Responsibilities

  • You are responsible for maintaining the security of your Apple ID (iOS) or Google account (Android) and the device on which the App is installed.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate information and to keep your account information current.
  • You agree to notify us promptly if you become aware of any unauthorized use of your account.

Guest Mode

You may use the App without creating an account. Guest users have access to Bible reading, sermon videos, event listings, service times, and church information. Account creation is required for donations, event RSVPs, and personalized push notifications.

5. Donations and Payments

General Terms

Donations made through the App are voluntary financial contributions to Iglesia Cristiana El Getsemani, a 501(c)(3) nonprofit religious organization. Donations are not payments for goods or services. No goods, products, or services are exchanged in return for donations.

Payment Processing

All donations are processed by Stripe, Inc., a PCI DSS Level 1 certified payment processor. By making a donation, you agree to Stripe's terms of service and privacy policy. The Church does not collect, store, or have access to your payment card details.

The App also supports Apple Pay (iOS) and Google Pay (Android), which provide an additional layer of security by using device-specific tokens instead of your actual card number.

Minimum Donation

The minimum donation amount is $1.00 USD.

Refund Policy

Because donations are voluntary charitable contributions and no goods or services are exchanged, refunds are generally not provided. However, if you believe a donation was processed in error (such as a duplicate charge or incorrect amount), you may request a refund by contacting us:

Refund requests must be submitted within 90 days of the original transaction. Refund requests are reviewed on a case-by-case basis at the sole discretion of the Church. Approved refunds will be processed through Stripe to the original payment method.

Tax Deductibility

Donations made through the App may be tax-deductible to the extent allowed by law for contributions to a 501(c)(3) organization. The Church does not provide tax, legal, or financial advice. You are solely responsible for consulting a qualified tax professional regarding the deductibility of your contributions. The Church may provide donation receipts or summaries for tax purposes upon request.

Giving History

Your donation history (amounts, dates, and fund designations) is stored in your account and accessible within the App. If you delete your account, personal identifiers in donation records are anonymized, but transaction records are retained in anonymized form for church accounting purposes.

6. Acceptable Use

You agree to use the App only for its intended purposes as described in these Terms. You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.
  • Attempt to gain unauthorized access to the App, its servers, or any systems or networks connected to the App.
  • Interfere with or disrupt the operation of the App, including through the use of viruses, bots, worms, or other malicious code.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Use the App to transmit any harassing, abusive, threatening, defamatory, or otherwise objectionable content.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the App to make fraudulent donations or use stolen payment credentials.
  • Reproduce, modify, distribute, or create derivative works based on the App without our express written permission.
  • Use automated scripts, bots, or other automated means to access or interact with the App.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including reporting such activity to law enforcement authorities.

7. Intellectual Property

Church Content

The App, including its design, layout, graphics, logos, icons, and original content, is the property of Iglesia Cristiana El Getsemani and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Church content without our prior written consent.

Bible Content

The Bible text included in the App is provided for personal, non-commercial devotional use:

  • New King James Version (NKJV): Scripture taken from the New King James Version. Copyright 1982 by Thomas Nelson, Inc. Used by permission. All rights reserved.
  • Reina-Valera 1960 (RV1960): Scripture taken from the Reina-Valera 1960 version. Copyright 1960 by Sociedades Biblicas en America Latina. Used by permission.

Use of Bible text within the App is subject to the terms and restrictions of the respective copyright holders. You may not extract, copy in bulk, or redistribute the Bible text from the App.

Sermon Content

Sermon videos displayed in the App are hosted on YouTube and are the intellectual property of Iglesia Cristiana El Getsemani and its pastors. Viewing is permitted through the App; redistribution or commercial use is prohibited without written consent.

User Acknowledgment

You acknowledge that you do not acquire any ownership rights by downloading or using the App.

8. Push Notifications

Consent

Push notifications are entirely optional and require your explicit consent. When you first enable notifications, your device will prompt you for permission. You are not required to enable notifications to use any other feature of the App.

Notification Categories

The App may send notifications related to:

  • Live stream announcements
  • Church event reminders
  • Service schedule changes or cancellations
  • General church announcements

Managing Notifications

  • In the App: Go to More > Notification Settings to manage specific notification categories.
  • On iOS: Go to Settings > Notifications > Iglesia El Getsemani to disable all notifications or customize how they appear.
  • On Android: Go to Settings > Apps > Iglesia El Getsemani > Notifications to disable all notifications or manage notification channels.

Frequency

We are committed to respectful communication. Push notifications are sent only for relevant church activities and will not be used for marketing to third parties or any purpose unrelated to church operations.

9. Third-Party Services

The App integrates with the following third-party services. By using features that rely on these services, you acknowledge and agree that your use is also subject to their respective terms and privacy policies:

Apple (Apple Inc.) — iOS

Google (Google LLC) — Android

We are not responsible for the privacy practices, data handling, or terms of any third-party service. We encourage you to review the privacy policies and terms of service of these third-party providers.

10. Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE CHURCH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES of merchantability, fitness for a particular purpose, and non-infringement.
  • WARRANTIES REGARDING the accuracy, reliability, completeness, or timeliness of any content, including Bible text, sermon videos, event information, and service schedules.
  • WARRANTIES THAT the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • WARRANTIES THAT any defects will be corrected.

The Church does not guarantee the availability of the App at any time. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

Bible text is provided for personal devotional use and should not be relied upon as the sole authoritative source. Users are encouraged to consult physical Bible editions and pastoral guidance.

Event information, service times, and other church details displayed in the App may change without notice. Always confirm time-sensitive information directly with the Church.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IGLESIA CRISTIANA EL GETSEMANI, ITS PASTORS, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, OR AFFILIATES (COLLECTIVELY, THE "CHURCH PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of data, loss of revenue, loss of goodwill, loss of anticipated savings, or other intangible losses.
  • Any damages arising from: (a) your use of or inability to use the App; (b) unauthorized access to or alteration of your data; (c) the conduct or content of any third party on or through the App; (d) any content or information obtained through the App; or (e) errors, mistakes, or inaccuracies in content.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE CHURCH PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF DONATIONS YOU HAVE MADE THROUGH THE APP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort (including negligence), strict liability, or any other theory, and whether or not the Church Parties have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of the Church Parties shall be limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Iglesia Cristiana El Getsemani, its pastors, officers, directors, employees, volunteers, agents, and affiliates from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with:

  • Your use of or access to the App.
  • Your violation of these Terms.
  • Your violation of any applicable law, regulation, or ordinance.
  • Your violation of any rights of any third party, including intellectual property, privacy, or publicity rights.
  • Any donation dispute initiated by you or your financial institution (including chargebacks).
  • Any content or information you submit or transmit through the App.

This indemnification obligation shall survive the termination of these Terms and your use of the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States of America, without regard to its conflict of law principles.

You agree that any legal action or proceeding that is not subject to the arbitration provision in Section 14 shall be brought exclusively in the state or federal courts located in Montgomery County, Pennsylvania, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App ("Dispute"), you agree to first attempt to resolve the Dispute informally by contacting us at contact@iglesiaelgetsemani.org. You must provide a written description of the Dispute, including all relevant facts and your desired resolution.

The parties shall engage in good faith negotiation for a period of thirty (30) days from the date of receipt of the written notice before pursuing any other form of dispute resolution.

Binding Arbitration

If a Dispute cannot be resolved through informal negotiation within the 30-day period, you and the Church agree that the Dispute shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA), rather than in court.

  • Arbitration shall take place in Montgomery County, Pennsylvania.
  • The arbitration shall be conducted by a single arbitrator.
  • The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
  • Each party shall bear its own costs of arbitration, including attorneys' fees, unless the arbitrator determines otherwise.

Class Action Waiver

YOU AND THE CHURCH AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Exceptions

The following are not subject to the arbitration provision:

  • Claims that may be brought in small claims court, if eligible.
  • Claims related to intellectual property infringement.
  • Requests for injunctive or equitable relief to prevent imminent harm.

15. Termination

By the Church

We reserve the right, in our sole discretion, to suspend or terminate your account and access to the App at any time, with or without cause and with or without notice, including but not limited to cases where:

  • You violate these Terms or any applicable law.
  • You engage in fraudulent activity, including fraudulent donations or use of stolen payment credentials.
  • Your conduct is harmful or disruptive to the App, the Church, or other users.
  • Continued operation of your account poses a security risk.

By You

You may terminate your account at any time by:

  • In-App deletion: Go to More > Profile > Account Management > Delete My Account.
  • Email request: Send a deletion request to contact@iglesiaelgetsemani.org.
  • Phone request: Call (484) 945-2660.

Effect of Termination

Upon termination of your account, whether by you or by the Church:

  • Your access to account-based features will cease immediately.
  • Your profile, RSVPs, notification subscriptions, and saved payment methods will be deleted.
  • Donation records will be anonymized and retained for church accounting purposes as described in our Privacy Policy.
  • You may continue to use the App in guest mode (Bible reading, sermon videos, church information).

Sections 6, 7, 10, 11, 12, 13, 14, 16, and 17 shall survive termination of these Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Iglesia Cristiana El Getsemani regarding your use of the App. These Terms supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, between you and the Church with respect to the App.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. The Church's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
